General terms and conditions (JOIN MOMENTUM LIMITED)

These terms and conditions govern all transactions conducted via the websites operated by Join Momentum Limited ("the Company"). Any individual or entity placing an order through our Growth Academy platform is referred to as "the Client" and is deemed to accept these terms and conditions without reservation.

Article 1: Scope of Application

These general conditions of sale apply to all products and services offered by Join Momentum Limited, including simulation programs, courses, and associated services. Any order validated via our secure payment platform or other approved methods (e.g., cheque, cash) implies acceptance of these conditions.

Article 1a: Age Limit

The Company only accepts clients:

Over 16 years old for physical and electronic products.
Over 18 years old for services such as coaching, workshops, and seminars.

Clients under the required age will have their transactions canceled, and any payments made will be refunded. Access to services and products will also be revoked.

Article 2: Order

By placing an order on any Join Momentum Limited platform, the Client accepts these terms and conditions. Orders are deemed complete once payment is received and confirmation is sent to the Client.

Article 3: Price

Prices are listed in Pounds Sterling (£) and include VAT (currently at 20%). Shipping and processing fees are excluded unless otherwise stated. Prices are subject to change, but the price at the time of order confirmation will apply.

Article 4: Payment

Payment is due immediately upon order placement. Accepted payment methods include:

Credit and debit cards (Visa, Mastercard). Cards from non-UK banks must be international cards.
Payments are processed securely through Stripe. Join Momentum Limited is not liable for any security breaches occurring within Stripe’s systems.

Upon successful payment, the Client will receive a receipt or invoice via email.

Article 5: Delivery

Delivery is made to the address provided at the time of order. Clients are responsible for ensuring accurate address details. Risks transfer to the Client upon dispatch of goods.

Delivery Timelines: Estimated delivery times are provided but not guaranteed.
Lost or Delayed Packages: In case of loss or delay, the Company will provide a replacement or refund in line with applicable laws.

Article 6: Protection of Personal Data

Join Momentum Limited complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. By using our services, Clients agree to our data collection, processing, and storage practices as outlined in our Privacy Policy.

Data Subject Rights: Clients have the right to access, rectify, erase, or object to the processing of their data. Requests can be submitted via email to support@joinmomentum.co.uk
Newsletter Subscription: Clients may receive promotional emails. They can unsubscribe at any time by clicking the unsubscribe link included in each email.

Article 7: Right to Cancel

Under the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013, Clients have the right to cancel their purchase within 14 days of receipt, except for:

Digital products once accessed.
Services that have commenced with the Client’s prior consent.

To exercise this right, Clients must notify the Company in writing at hello@joinmomentum.co.uk. Refunds will be processed within 14 days of cancellation.

Article 8: Intellectual Property

All content provided by Join Momentum Limited, including courses, simulations, and materials, is the intellectual property of the Company. Unauthorized reproduction, distribution, or use is strictly prohibited.

Article 9: Liability Disclaimer

Join Momentum Limited is not liable for:

Platform down times or interruptions.
Errors or failures of third-party services, such as Stripe or Systeme.IO.
Any indirect or consequential damages arising from the use of our services.

The Company’s liability is limited to the value of the transaction.

Article 10: Complaints Procedure

Clients can raise complaints by contacting support@joinmomentum.co.uk Complaints will be acknowledged within 3 business days and resolved within 14 business days where possible.

Article 11: Force Majeure

Join Momentum Limited is not liable for delays or failures caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, or government actions.

Article 12: Termination of Service

The Company reserves the right to terminate service to any Client in cases of:

Breach of these terms and conditions.
Misuse of the platform or resources.
Non-payment of dues.

In such cases, refunds may not be provided.

Article 13: Governing Law

These terms and conditions, as well as all related transactions, are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England and Wales.
